WHY DO WE PROCESS YOUR PERSONAL DATA?
Your personal data will be processed for health purposes including health prophylaxis, medical diagnose, treatment, social security provision, systems and services management and also for the purpose of issuing certificates, defense against claims and for marketing purposes.
LEGAL BASIS OF PERSONAL DATA PROCESSING
Your personal data will be processed on the basis of:
art. 6 par. 1 point a) and art. 9 par. 2 point a) of the General Data Protection Regulation to the extent to which your personal data are processed on the basis of your consent to their processing, in particular in the event that the Company wants to encourage you to take advantage of its services or inform about the current offer of services provided, as well as when they would like to show achievements in the field of the services provided, including publishing your image or photo of the jaws before and after the treatment;
art.6 par.1 point b) and d) of the General Data Protection Regulation;
art.6 par.1 point f) of the General Data Protection Regulation in relation to personal data which was gained by recording your image on recordings from monitoring cameras to protect people and property in the clinic;
art.9 par.2 point c), f) and i) of the General Data Protection Regulation;
art.9 par.2 point h) of the General Data Protection Regulation which provision is applicable in connection with the following provisions of national law:
art. 3 par. 2 of the Act on Medical Activity and Art. 24 of the Act on Patients’ Rights and the Patient’s Rights Ombudsman, when your data are processed for the purpose of health prophylaxis;
-art. 3 par. 1 of the Act on Medical Activity and art. 24 of the Act on Patients’ Rights and the Patient’s Rights Ombudsman, when your data are processed for medical diagnosis and treatment;
-art. 54 of the Act on cash benefits from social insurance in case of illness and motherhood or other relevant provisions in the field of social security law, when processing is held in order to ensure social security and management of social security systems and services.
The above mentioned purposes and legal basis of processing your personal data mean that without your permission the Company will be able to process your personal data for the purpose of keeping medical record, while working out the diagnosis and the proper way of your treatment. The Company will also be able to do it when they want to inform you about pro-health events, while performing medical services for you, when it is necessary to issue a medical certificate, and also in the situations indispensable for saving your health and life and other people’s health and life. You will receive advertising materials only if you agree to it. Besides the Company, only with your permission, will take advantage of your image or the image of some part of your jaw in the form of photos taken before and after the treatment conducted in Titanium Clinic publishing them on their website or on Facebook.
HOW LONG WILL YOUR PERSONAL DATA BE PROCESSED FOR?
Your personal data will be processed (stored) for 21 years and X-ray photos will be stored besides medical documentation for 11 years, in accordance with art. 29 of the Act of November 6, 2008 on Patient Rights and Patient’s Rights Ombudsman (Dz.U.2017.1318).
DO YOU HAVE TO SUBMIT YOUR PERSONAL DATA?
Submission of your personal data is voluntary however in case of not submitting personal data necessary to realization of medical services , preparation of diagnosis and beginning the treatment, it will not be possible to sign and to realize the contract or to undertake any activities requested by you.
WHO WILL BE THE RECEIVER OF YOUR PERSONAL DATA?
Your personal data will be received by entitled employees of the Company or other people who the Company cooperates with including people performing medical profession, people performing auxiliary activities while providing health care, people responsible for security and maintenance of IT system, where your data are processed and also the people who commissioned by the Company deal with settling the accounts between you and the Company. All these people are obliged to keep professional secrets.
DO YOU HAVE AN ACCESS TO YOUR PERSONAL DATA?
You have an access to your personal data and also you have the right to rectify them, delete them, limit their processing, the right to data transfer, the right to object to the processing. However having regard to the purpose of processing data about your health condition as well as the obligation of keeping medical records, the right to limit data processing, to transfer data or to object to its processing is excluded in relation to such data.
CAN THE GIVEN CONSENT BE WITHDRAWN?
You have the right to withdraw the consent to processing your personal data at any time. Operations on your personal data carried out until withdrawal of consent for their processing remain in accordance with applicable law.
You have the right to make a legal claim to President of the Office for Personal Data Protection if you decide that processing of your personal data violates the provisions of the general regulation on the protection of personal data or provisions of national law.
WILL YOUR PERSONAL DATA BE TRANSFORMED TO THE THIRD COUNTRY?
Your personal data will not be transferred to the third country or to any international organization.

The Company does not make any automated decisions on the base of your personal data including basing on profiling.
